What will happen on Saturday and Sunday. Can an employee take leave only for weekdays, excluding weekends, by writing two applications? How not to waste your weekend

Answer: Taking into account the norms of the Labor Code of the Russian Federation, with a 5-day working week, Sunday should be a day off, while the second day off may precede Sunday (Saturday) or follow it (Monday).

If the suspension of work at the employer is impossible due to production, technical and organizational conditions, days off may be provided on different days of the week. At the same time, if the suspension of work on non-working holidays is impossible due to production, technical and organizational conditions, the transfer of days off is not carried out.

Rationale: Weekends and working days are an integral part of the working hours.

By working time regime, the Labor Code of the Russian Federation understands the distribution of working time during the day, week, month, or other calendar period.

In accordance with Art. 100 of the Labor Code of the Russian Federation, the working time regime must provide for the duration working week(five-day with two days off, six-day with one day off, working week with days off on a rotating schedule, part-time work), work with irregular working hours for certain categories of workers, duration daily work(shifts), including part-time (shifts), start and end times of work, breaks in work, number of shifts per day, alternation of workers and non-working days, which are established by the internal rules labor regulations organizations in accordance with the Labor Code of the Russian Federation, other federal laws, collective agreement, agreements, employment contract.

As established by Art. 111 of the Labor Code of the Russian Federation, all employees are provided with days off (weekly uninterrupted rest). With a five-day work week, employees are given two days off per week, with a six-day work week - one day off, with the general day off being Sunday. The second day off in a five-day work week is established by a collective agreement or internal labor regulations.

As a rule, both days off must be consecutive. In a five-day work week, the second day off may precede Sunday (Saturday) or follow it (Monday). The definition of the second day off is made in the internal labor regulations or in the collective agreement.

Employees in continuously operating organizations, when, due to the nature of the work or production and technical conditions, work cannot be suspended, as well as employees of organizations where work cannot be interrupted on a general day off (for example, due to the need to serve the population (shops, transport organizations, theaters, museums, etc.)), days off on different days of the week can be provided alternately to each group of workers in accordance with internal labor regulations in cases where, due to production, technical or organizational conditions, it is impossible to establish a generally established or common day off for everyone ( Part 3 of Article 111 of the Labor Code of the Russian Federation).

According to Part 2 of Art. 112 of the Labor Code of the Russian Federation, if a day off coincides with a non-working holiday, the day off is transferred to the next working day after the holiday.

The peculiarities of transferring days off when they coincide with non-working holidays under different operating modes are established in clause 2 of the Procedure for calculating the norm of working time for certain calendar periods of time (month, quarter, year) depending on the established duration of working time per week, approved by the Order of the Ministry of Health and Social Development of Russia dated August 13, 2009 N 588n.

In accordance with clause 2 of the said Procedure, the transfer of days off that coincide with non-working holidays is carried out by employers using various work and rest regimes, in which work is not performed on holidays. This procedure for transferring days off that coincide with non-working holidays applies equally to work modes with both permanent weekends fixed by day of the week and with sliding days of rest.

For employers whose work suspension on non-working holidays is impossible due to production, technical and organizational conditions, the transfer of days off provided for in Part 2 of Art. 112 of the Labor Code of the Russian Federation, is not carried out.

Article 111 of the Labor Code of the Russian Federation establishes a general day off - Sunday. Is it legal to establish a five-day work week with days off on Monday and Tuesday in the internal labor regulations of an organization? How to deal with transfers holidays falling on weekends?

You've probably heard that most Christians consider Sunday to be a special day when they should attend church. But if you want to find an explanation for this in the Bible, then you will fail. The Bible calls Saturday a special day.

1:0

GodI especially highlighted Saturdayafter the creation of our planet.

In the first book of Scripture it is written: “God blessed the seventh day and made it holy, making it a special day, because on that day He rested from the labors with which He was busy creating the world” (Genesis 2:3, modern translation).

Some people argue that the Sabbath was given exclusively to Jews. But Adam and Eve, its first “recipients,” were not Jews or representatives of any other nationality, but were the progenitors of all races on earth.

2:0

The command to keep the Sabbath was written among the 10 Commandments.

“The Lord said to Moses: “Come to Me on the mountain. I wrote down My teachings and laws for people on two stone tablets. I will give you these tablets” (Exodus 24:12, modern translation).

Here's what it said: “Remember that the Sabbath is a special day. Six days you shall work, but the seventh day is a day of rest in honor of the Lord your God, and therefore no one shall work on that day” (Exodus 20:8–10, Modern Version). This is the fourth commandment of the Law of God, it is located between the prohibition of taking the name of God in vain and the command to honor parents, which means it is no less important!

3:0

Jesus Christ honored the Sabbath.

“And He came to Nazareth, to the city where he grew up. On the Sabbath day He went into the synagogue as was His custom, and stood up to read the scriptures before those present” (Luke 4:16, Modern Version).

If Jesus wanted His disciples to keep Sunday instead of Saturday, why didn't He tell them to? Yes, Jesus was accused of breaking the Sabbath, but that was because He was breaking human traditions, not God's commandments! “Do not think that I came to destroy the law or the prophets: I did not come to destroy, but to fulfill” (Matthew 5:17), He said.

4:0

The apostles and disciples kept the Sabbath even after the resurrectionJesus Christ.

If you ask some Christians why they keep Sunday as a holy day, they will answer: “Because on this day Christ was resurrected.” But as we read the Bible, we see that Christ's disciples continued to keep the Sabbath as God's unchangeable decree (Acts 13:14, 16:13).

There is historical evidence that Christians celebrated Sabbaths until the Council of Laodicea in Rome in 336. In other places, Christians kept the Sabbath even longer. The fifth-century scholastic church historian Socrates left us the following important testimony: “Almost all churches celebrate the sacred sacrament (the Last Supper) on Saturday every week. However, Christians in Alexandria and Rome, due to some ancient traditions, abandoned this. The Egyptians in the districts neighboring Alexandria and the inhabitants of Thebes observe religious assemblies on the Sabbath" (Socrates Scholasticus, Ecclesiastical History, 5.22 (NPNF)/22:132).

5:0

There is a prophecy in the Bible that we will keep the Sabbath andin eternal life.

“Then from month to month and from Sabbath to Sabbath all flesh will come before Me to worship, says the Lord” (Isaiah 66:23).

Who and why moved the day of worshiping God from Saturday to Sunday? You can find out about this in the book "Almost Forgotten Day".

It’s always like this with these weekends: you wait for them, you wait, and then they’re over! And it seems like there were so many plans, to relax, and to do things that you couldn’t get around to, but as a result, you didn’t have time to do anything, and you meet the new week tired, as if this Saturday and Sunday never happened.

elusive weekend

If you are one of those who on Sunday evening looks back with bewilderment and sadly states that “another weekend has passed in vain...”, then don’t be upset: you are the majority on this planet.

The thing is that during the working week our routine is strictly structured (work, travel, list of household and personal tasks), and on weekends we usually try to get rid of structure. We have a rough idea of what we want to do, but since the schedule is flexible, most often we do not have enough self-discipline to do everything properly.

This is exactly what Matt Lovell, author of the Productive Weekend course, talks about. Well, yes, I understand that the very thought that even the sacred - Saturday and Sunday - needs to be made productive makes me want to cry and immediately eat a chocolate muffin.

But wait to dismiss Matt and his theory, there is a rational grain in it!

How not to waste your weekend

The main idea conveyed by the author of the course is simple: in order not to waste your weekend, you need to decide the day before what you want to do on Saturday and Sunday. And at the same time, promise yourself that you will spend your free time on exactly what you want, and will not be distracted by any nonsense.

If you feel tired and need a rest, great, rest! But rest properly, and not in fits and starts. Turn off your phone, get a good night's sleep, go to the park, to the pool, for a massage, that is, fill your weekend with relaxing activities. Do not turn on the computer so as not to get stuck in front of the monitor again, free these days from household activities (cleaning can be done on other days). Relax and relax.

And if you realize that you have a backlog of things to do, then plan in advance how and what you will do and do everything properly. Set your alarm, get everything you need ready, and calmly put your plan into action without distractions so that you can go to bed on Sunday night proud of how much important you got done.

Weekend killers

The disappointment that we experience at the end of the weekend is most often due to the fact that we fall out of the usual routine of working days, and we do not have a weekend routine. We stupidly cram a bunch of different things into Saturday and Sunday that we don’t have time to do because we’re lazy, we sleep longer, we eat longer, etc. The difference between the rhythm of the weekend and the plans that we cherish most often results in In the end, we don’t have time to do anything: neither rest properly, nor do what we were going to do.

How to avoid this? Matt advises developing your own weekend routine, just like we do during the week. For example:

  • Saturday: wake up, breakfast, sports, lunch, meeting with friends or family, SPA, sleep.
  • Sunday: wake up, breakfast, walk and lunch, household chores, preparation for the week, sleep.

Everyone will have their own routine, but the most important thing is to try to create something like a pattern that suits you and that you try to stick to every weekend. Over time, “weekend habits” will take root, and you will easily be able to do everything you need to do.

switching modes

Another reason why weekends do not become a pause and respite between working days is the lack of new activities, i.e. the lack of switching from work mode to rest mode. If, at its core, your weekend is a stripped-down version of your everyday life (the day is filled with similar activities, with the exception of work), then you will not have the feeling of a break.

This is why it is important to create Saturday and Sunday habits that will separate these days from the rest of the week. Delicious family breakfasts (after all, getting together at one table on weekdays is not easy), activities outside the city that are impossible during the week, Sunday lunches with friends, sports and spa, etc. If you spend the whole Saturday and Sunday wandering around the city in the same way, As it happens on weekdays, what remains from your weekends are horns and legs.

Meet: weekend!

You need to pamper and cherish your weekends, and protect them from small things that you can easily get done on weekdays, writes Matt. Treat Saturday and Sunday as a mini-vacation, time for yourself and for your family, and not just two days when you don’t have to go to work. Do you want the coming weekend not to fly by in vain? Take 10 minutes to dream up your ideal weekend and simply answer the following questions:

  • What activities have you already planned for these days?
  • Can these things really only be done on weekends, or can you free your Saturdays and Sundays from them by shifting them to weekdays? Maybe grocery shopping can be replaced by online shopping with delivery, and the freed-up time can be spent on something more enjoyable? How about spreading out the cleaning on weekdays, as is recommended?..
  • Is it possible to plan everything so that your tasks are completed in one day (or even half a day), and you can still spend the second day doing enjoyable activities?
  • If you think about it carefully, what is your priority for this weekend: how to rest, sleep and recuperate? Spend quality time with children? Expand your horizons and learn something new? Meet new people? Spend time creating the mood and comfort of your home? Switch and get new experiences? Raise the degree of romance in your relationship, slightly suppressed by routine?.. Answer this question for yourself and make this answer your top priority for the coming weekend.
  • When you know what you want, feel free to plan - classes, schedule, menu, activities, etc., etc. And make sure in advance that your home has everything you need to make your Saturday morning go just like that, as you intended. After all, the weekend begins on Saturday morning - how you start the weekend is how you will spend it!

Enjoy your holiday!

Question about Labor Code RF is possible to break 28 calendar days vacation with the proviso that one part of the vacation must be at least 14 days. The employee used one part of the vacation (14 calendar days), and then wanted to take vacation for five working days from Monday to Friday inclusive. However, the HR department advised that all seven days of the week (including Saturday and Sunday) should be taken. Is this position legal? (Expert consultation, 2008)

Question: According to the Labor Code of the Russian Federation, it is possible to split 28 calendar days of vacation with the proviso that one part of the vacation must be at least 14 days. The employee used one part of the vacation (14 calendar days), and then wanted to take vacation for five working days from Monday to Friday inclusive. However, the HR department advised that all seven days of the week (including Saturday and Sunday) should be taken. Is this position legal?
Answer: The duration of the annual basic paid leave is 28 calendar days (Article 115 of the Labor Code of the Russian Federation).
By agreement between the employee and the employer, annual paid leave can be divided into parts. Moreover, at least one part of this vacation must be at least 14 calendar days (Article 125 of the Labor Code of the Russian Federation).
Let us note that the norms of labor legislation obliging the employer to provide employees with paid leave annually are primarily aimed at ensuring that the employee has the opportunity to use the leave in full during the year.
However, at the same time, the legislator does not object to dividing the vacation into parts.
In this case, one of the parts of the vacation must be at least 14 days. The legislator does not determine how to use the rest of the vacation. Determining the procedure for using the remaining part of the vacation is the right of the employee and the employer.
And since there is no legal restriction, the employee can use the rest of the vacation at his own discretion. He can divide the rest of the vacation into 2, 3 or even 14 parts. However, the employee can dispose of the remainder of the vacation in this way only by agreement with the employer.
If the employer objects to dividing the vacation into parts, the employee cannot independently go on vacation for the time that he has determined for himself.
If the employee and the employer do not agree on the procedure for dividing the vacation into parts, the employee can only use his vacation in full.
Let us note that the employer, in turn, does not have the right to insist that the employee’s vacation be divided into parts. If the employee objects to the division of leave, the employer is obliged to provide the employee with annual paid leave in full.

The approach of a long-awaited, well-deserved rest from work makes any worker happy. In anticipation of it, especially if this is the first experience official work, several reasonable questions arise:

  1. Are weekends (Saturday and Sunday) included in vacation days?
  2. Are they included? official holidays Russia on vacation days?

Special Examples

You can go on vacation for a short period of time, when there are no days off in between. Then the worker is interested in whether adjacent weekends will be added to the amount of vacation? After all, it depends on how many days of vacation the employee used out of all allotted. Answer: no, weekends will not be added to vacation automatically.

Some special employees (clause 2 of article 19 of the Law of June 26, 1992 No. 3132-1; article 295 of the Labor Code of the Russian Federation), such as seasonal workers or judges, are granted leave in working days, based on a six-day working week. So, Saturday is included in vacation, but Sunday is not included and moves the final date of vacation (Part 5 of Article 139 of the Labor Code of the Russian Federation).

Advice: To avoid calculations, which can get confusing, take a calendar. Count, starting from the first day when the rest provided to you begins, mark each day, including Saturday and Sunday, and “jump over” holidays. This way you can easily decide on the date you will go back to work while planning a convenient time that you can devote to yourself.

All these norms apply only to those workers who are officially employed. Otherwise, no one guarantees compliance with legal norms, since where there is no official employee on staff, there is no responsibility before the law in relation to the worker. Social package belongs full-time employees enterprises and in case of non-compliance with one of the norms, you can appeal the issue to the relevant authorities.
